<p>Greece has become a member of the Visa Waiver Program (VWP), the Department of Homeland Security (DHS) has announced. DHS estimates that, in about 30 days, Greek citizens should be able to begin using the program to make short trips for business or tourism visits without the need to obtain a visa, provided that they meet program requirements.</p>
<p>The Visa Waiver Program allows foreign nationals from designated countries to enter the United States for business visits or tourism visits up to 90 days without the need to obtain a B-1/B-2 visitor visa from a U.S. consulate. Greece joins 35 other countries that already participate in the program. These are Andorra, Australia, Austria, Belgium, Brunei, the Czech Republic, Denmark, Estonia, Finland, France, Germany, Hungary, Iceland, Ireland, Italy, Japan, Latvia, Liechtenstein, Lithuania, Luxembourg, Malta, Monaco, Netherlands, New Zealand, Norway, Portugal, San Marino, Singapore, Slovakia, Slovenia, South Korea, Spain, Sweden, Switzerland, and the United Kingdom.</p>
<p>To use the VWP, Greek citizens must hold an “e-Passport” embedded with an integrated computer chip that stores the traveler’s biographic data, digital photograph and other information. Like all VWP travelers, they will also be required to register and obtain an approval to travel in the Electronic System for Travel Authorization (ESTA) before departing for the United States. <p>Costa Rica adopted a new immigration law that went into effect on March 1, 2010. In addition to significant changes to the business visitor and temporary residence categories (reported <a href="http://www.fragomen.com/EmailMarketing/ClickThroughHandler.aspx?link=%3ca+href%3d%22http%3a%2f%2fwww.fragomen.com%2fnewsresources%2fxprNewsDetailFrag.aspx%3fxpST%3dGlobalAlerts%26news%3d602%22%3ehttp%3a%2f%2fwww.fragomen.com%2fnewsresources%2fxprNewsDetailFrag.aspx%3fxpST%3dGlobalAlerts%26news%3d602%3c%2fa%3e&amp;nid=343a9cbe-086e-4fc6-a277-5e031ef99270&amp;clid=e56ca84b-9c67-48c3-85df-e1ec3dca0291&amp;cid=cbd3691f-9ab6-4361-b3b8-0d8742e85fcf&amp;ce=wHofB%2fdh1uVB3NgdaV9Li70eAfhEAGAQ" target="_blank">here</a>), the new law introduces a new social security registration requirement for residence and work permit applicants, imposes heightened penalties on foreign nationals who remain in Costa Rica beyond their authorized period of stay and significantly increases filing fees for residence applications.</p>
<p><strong>New Social Security Registration Requirement</strong><br />
Foreign applicants for residence and work authorization, including intracompany transferees and seconded employees who remain on their home country employer’s payroll, must now provide proof that they have registered with the Costa Rican Social Security Administration (CCSS) prior to submitting their applications, including change-of-status and renewal applications. Applications submitted by unregistered foreign nationals will be denied. Previously, while foreign nationals were subject to the social security registration requirement, they were not required to provide proof of their registration with the CCSS prior to applying for residence or work authorization.</p>
<p><strong>New Penalties for Noncompliance </strong><br />
Foreign nationals who remain in Costa Rica beyond their authorized period of stay are now subject to fines of US$ 100 per month of overstay. Foreign nationals who do not pay their fines for overstaying are now barred from re-entering Costa Rica for a period equal to three times the period of their overstay. For example, if a foreign national remains in Costa Rica illegally for two months and fails to pay the corresponding fine, he or she will be barred from reentering Costa Rica for six months from the date of his or her last departure.</p>
<p><strong>Heightened Filing Fees for Residence Applications </strong><br />
Under the new law, filing fees for initial and renewal residence applications increased to US$ 250 (up from US$ 30), and US$ 123 (up from US$ 58) respectively.</p>
<p>The Costa Rican authorities have not yet issued implementing regulations for the new law. Fragomen is monitoring the situation and will provide updates as they become available.</p>

<p>Work permit processing   times for Warsaw, Poland have doubled from thirty to sixty days due to new   filing procedures that took effect at the beginning of the year.</p>
<p>New work permit  application processes in Warsaw, Poland have caused processing times to   double – from 30 days to 60. Since January 1, applications for both work permits and residence permits for   Warsaw must be submitted to the Mazowieckie Provincial Office, instead of   being submitted to two different provincial offices. This new, simplified   procedure was expected to cause delays initially, but not as significant as   those now being reported. Polish Immigration Offices outside of Warsaw were   unaffected by the change.</p>
<p>Note that Polish work permit application procedures will be further   simplified next year, with the introduction of the EU Blue Card, which will   combine the residence permit and the work permit into one single document.</p>

<p>U.S. consulates and embassies will soon require nonimmigrant visa  applicants to use Form DS-160, the Department of State’s fully  electronic nonimmigrant visa application, instead of Form DS-156, the  paper-based application. Form DS-160 has been in use at selected U.S.  diplomatic posts for some time, but the State Department announced late  last year that all U.S. posts will require the online form by April 30,  2010 at the latest. Many posts have already adopted the form, and more  will begin to require it as April 30 approaches.</p>
<p>The following  are some frequently asked questions about using the DS-160 online  application. More information on the form, including technical  instructions and requirements, is available at the State Department’s  website <a href="http://travel.state.gov/visa/frvi/forms/forms_4401.html">here</a>.</p>
<p>Form DS-160 is available at <a href="https://ceac.state.gov/genniv/">https://ceac.state.gov/genniv/</a>.</p>
<hr /><strong><em>NOTE</em>: The DS-160 website has been experiencing  widespread technical slowdowns and may be inaccessible for lengthy  periods of time. The State Department is aware of the problem and is  attempting to address it. If you are unable to access the DS-160 site or  complete the form, contact the consulate where you will apply for your  visa. As an interim measure, the consulate may accept Form DS-156, the  paper-based nonimmigrant visa application, until the DS-160 problems are  resolved. See Questions 12 and 13 below for more information.<br />

<p><strong>1. How can I find out whether a specific U.S. embassy or  consulate requires Form DS-160? </strong></p>
<p>To find out whether  DS-160 is being used at the U.S. diplomatic post where you will apply  for a nonimmigrant visa, contact the post. Links to all U.S. embassies  and consulates websites can be found at <a href="http://usembassy.gov/">http://usembassy.gov/</a>.</p>
<p>The  form is currently in use at many diplomatic posts, and more will be  adding the requirement between now and April 30, 2010. Visa application  requirements are subject to frequent change without notice, so even if  the post does not currently require Form DS-160, make sure to check  again before your visa appointment to ensure that you meet the most  current requirements.</p>
<p><strong>2. How is Form DS-160 different  from Form DS-156?</strong></p>
<p>Form DS-160 consolidates several  nonimmigrant visa application forms into a single electronic document.  It replaces Form DS-156 and most of the paper supplements to that form,  including Form DS-157, the supplemental nonimmigrant visa application  used by male applicants between the ages of 16 and 45 among others, and  Form DS-158, the contact and work history form used by applicants for  student or exchange visitor visas.</p>
<p>Unlike Form DS-156, Form  DS-160 is completely electronic. It is filled out and submitted to the  State Department online. While Form DS-156 can be filled out online, it  has to be submitted in hard copy to the consulate.</p>
<p>Form DS-160  contains all of the questions included in Forms DS-156, DS-157 and  DS-158, but also asks for some details that were not previously  requested of nonimmigrant visa applicants, such as whether the applicant  has ever held a U.S. driver’s license or Social Security number.</p>
<p>As  you move through the DS-160 electronic form, you will be asked to input  your application information. Depending on your answers to certain  questions, you may be asked follow-up questions. For example, if you  answer “yes” to the question whether you have previously visited the  United States, follow-up questions about your previous trips will appear  on the screen. If you answer “no” to this question, no follow-ups will  appear.</p>
<p><strong>3. While I am filling out Form DS-160, should I  save my work as I go along? Should I save an electronic copy once I am  finished?</strong></p>
<p>Yes. It is very important to save your work  periodically as you progress through the form, because Form DS-160  website will “time out” and your data will be lost if more than 20  minutes go by without any activity. You may also experience problems  with your internet connection or with the State Department’s DS-160  website that could lead to data loss. Using the save options on Form  DS-160 can help minimize these problems. You should also save a copy of  your completed form.</p>
<p>There are two ways to save your work.  Choosing the “save” button on Form DS-160 will save your work  temporarily as you progress through the form, but will not save your  data if you close your web browser or if the DS-160 website times out  because of inactivity. To permanently save a partially or fully  completed form, choose the “save application to file” option, which will  allow you to save the form to a computer hard drive or CD. You can then  use the saved file to reload your data when you’re ready to resume  working on the form. You can also use a permanently saved file to load  your data to a subsequent DS-160 visa application. Note that if you  elect to reload saved data, you will be asked some security questions to  confirm your identity.</p>
<p>State Department technical instructions  on saving Form DS-160 are available <a href="http://travel.state.gov/visa/frvi/forms/forms_4401.html">here</a>.</p>
<p><strong>4. I am applying for a specific type of nonimmigrant  visa, but Form DS-160 does not seem to have a selection for the category  I need. How should I fill out the form in this situation?</strong></p>
<p>If  you are the principal visa applicant (i.e., not a dependent family  member of a principal applicant), you will be asked to enter the purpose  of your trip to the United States and select from several options, such  as “Business/Conference Visitor (B1),” “Tourist/Personal Travel Visitor  (B2),” “Student/Exchange Visa (F, M, J, Q)” or “Other.” If you do not  see the specific purpose of your trip listed in this question, select  “Other.” Once you make this selection, a second list of options, titled  “Other – Specify,” will appear. This list will include selections for  the E, H, L, O, P and other nonimmigrant visa categories that do not  appear in the preceding list. Choose the appropriate visa category from  this second list.</p>
<p>It is very important to select the correct  visa classification for your application. If you do not choose the  correct category, your application could be rejected when you appear for  your visa interview at the consulate.</p>
<p><strong>5. My spouse is  the principal visa applicant and I am applying for a visa as his/her  dependent. Form DS-160 does not seem to have any selections for the kind  of dependent visa I need. How should I fill out the form in this  situation?<br />
</strong><br />
If you are the dependent of a principal visa  holder or application – for example, you are the spouse of an H-1B visa  holder and you are seeking an H-4 dependent visa – the DS-160 online  system will ask you questions about the principal to determine the  appropriate visa category for you.</p>
<p>Once you begin filling out  Form DS-160, you will be asked whether you are the “principal applicant”  for a nonimmigrant visa. If you are a dependent, you should answer “no”  to this question. You will then be asked to enter the name of the  principal visa holder, the purpose of his or her trip, and possibly  other information, such as the receipt number of the principal’s USCIS  nonimmigrant visa petition or, in the case of a principal F student or J  exchange visitor, his or her identification number in the Student and  Exchange Visitor Information System (SEVIS). Your visa category will be  determined based on your answers to these questions.</p>
<p><strong>6.  What happens if I don’t fully answer a question on Form DS-160 or answer  incorrectly?</strong></p>
<p>It is very important to answer all  questions on the DS-160 completely and accurately and fill in all fields  requested on the form, because mistakes and omissions could cause your  application to be rejected. Some important pointers:</p>
<ul>
<li>Make sure to enter your complete, correct name, exactly as it  appears in your passport. If you have several middle names, enter all of  them on the application.</li>
<li>Include your complete education history, including your high  school education.</li>
<li>Include your complete travel history. Unless you are applying  for a crewmember visa, you must list all of your overseas travel on Form  DS-160.</li>
<li>Avoid entering “not applicable” or “none” unless you are  specifically offered that option on the form.</li>
</ul>
<p><strong>7. Is a photograph required with Form DS-160? </strong></p>
<p>Yes.  You may upload a digital photograph when you electronically submit Form  DS-160. Click <a href="http://travel.state.gov/visa/guide/guide_3877.html">here</a> for  State Department instructions on digital photographs for Form DS-160.</p>
<p>If  you are unable to upload a digital photograph – either because you  don’t have one or because your attempt to upload one was unsuccessful –  you must bring to your visa appointment a print photograph that meets  State Department requirements. Click <a href="http://www.travel.state.gov/visa/temp/info/info_1287.html">here</a> for print photograph instructions for nonimmigrant visa applications.</p>
<p>Note:  Some consulates that use Form DS-160 may require you to submit a  digital photograph, and may not accept a print photograph. Please  contact the consulate where you will apply for specific information.</p>
<p><strong>8.  After I fill out Form DS-160, will I need to complete any other  application forms?</strong></p>
<p>No, with some exceptions. Most  DS-160 applicants won’t need to complete any other visa forms. However,  if you are applying for an E treaty trader/investor visa or a K-1/2  fiance(e) visa, you may need to submit other forms in addition to or  instead of Form DS-160. See Questions 9 and 10 below.</p>
<p><strong>9.  I am applying for an E treaty trader/investor visa at a consulate that  requires Form DS-160. Do I need to fill out any other forms for my  application?</strong></p>
<p>Possibly. You or your employer may also  need to fill out a paper Form DS-156E, the Nonimmigrant Treaty  Trader/Investor Application to bring to your visa appointment.</p>
<p>A  paper Form DS-156E is required if you are applying for an E-1 treaty  trader visa or an E-2 treaty investor visa as an executive, manager, or  essential employee. If you are applying for an E-2 treaty investor visa  as a principal investor, you do not need to fill out Form DS-156E.</p>
<p>Form  DS-156E is available <a href="http://www.state.gov/documents/organization/79963.pdf">here</a>.  In the future, the Department of State will issue a fully electronic  nonimmigrant treaty trader/investor form, but it has not done so yet.</p>
<p><strong>10.  I am applying for a K-1/2 fiance(e) visa. Which nonimmigrant visa  application forms must I fill out?<br />
</strong><br />
If you are applying  for a K-1/2 visa, do not fill out Form DS-160. You must use the paper  nonimmigrant visa application, Form DS-156, and Form DS-156K, the  Nonimmigrant Fiance(e) Visa Application. Form DS-156 is available <a href="http://evisaforms.state.gov/">here</a>; the DS-156K is available <a href="http://www.state.gov/documents/organization/82063.pdf">here</a>.</p>
<p><strong>11.  Once I’ve completed and submitted Form DS-160, will I need to bring a  copy of the form to my visa interview? Should I print out or save the  filing confirmation that appears after I’ve submitted the form?<br />
</strong><br />
You  don’t need to bring a copy of the entire form to the interview.  However, after you fill out and submit the form, make sure to save and  print out a copy of the filing confirmation. You must bring a copy of  the confirmation to your appointment.</p>
<p>We also recommend that you  save an electronic copy of your completed DS-160 form in case you need  to resubmit the application or want to use your data for a future visa  application.</p>
<p><strong>12. Have visa applicants experienced any  technical problems with Form DS-160?<br />
</strong><br />
Yes. Recently,  foreign nationals trying to use the online Form DS-160 have encountered  persistent problems, due to widespread technical slowdowns with the  DS-160 website. These problems have increased lately because, as of  March 1, 2010, a large number of consulates implemented the DS-160 and  many more applicants began to use the online system, resulting in system  overloads. The State Department is aware of the problems and is  attempting to address them, but foreign nationals may be unable to  access the DS-160 for lengthy periods.</p>
<p>As an interim solution,  many consulates have resumed accepting Form DS-156, the paper-based  application, until the DS-160 problems are resolved. If you are unable  to access the DS-160 website, contact the consulate where you will apply  for a visa to see whether it will accept Form DS-156. See Question 13  for more information.</p>
<p>If you are able to access Form DS-160,  make sure to save your work frequently. Many applicants have lost data  because the form “timed out” or because of a faulty internet connection.</p>
<p><strong>13. I have been unable to access the DS-160 website for  some time, and my visa appointment will take place soon. What should I  do?<br />
</strong><br />
If you are unable to access Form DS-160 because of  the current State Department technical issues (discussed above), contact  the consulate to see whether it will accept Form DS-156, the  paper-based nonimmigrant visa application, and related paper forms  (available <a href="http://travel.state.gov/visa/frvi/forms/forms_1342.html">here</a>).  Because of the recent DS-160 technical problems, many consulates have  resumed accepting Form DS-156, the paper-based application, as an  interim solution.</p>
<p>Form DS-156 is completed online but must be  printed out and the hard copy brought to your visa appointment. Because  there could be technical slowdowns on the DS-156 website as well, make  sure to complete the form well in advance of your visa appointment, if  possible.</p>
<p><strong>14. I am applying for a nonimmigrant visa at a  consulate that does not use Form DS-160 yet. Which forms do I need to  fill out? </strong></p>
<p>If you will be applying for a nonimmigrant  visa before April 30 and the consulate where you will apply does not yet  use Form DS-160, you should plan to fill out Form DS-156, the  paper-based nonimmigrant visa application (available <a href="http://travel.state.gov/visa/frvi/forms/forms_1342.html">here</a>)  and any other forms required by the consulate. Form DS-156 is completed  online but must be printed out and the hard copy brought to your visa  appointment. Because there could be technical slowdowns on the DS-156  website, make sure to complete the form well in advance of your visa  appointment, if possible.</p>
<p>Even if the consulate does not  currently require the DS-160, you should check back with the consulate  before your visa appointment in case it has adopted the electronic form  and will require you to use it. More and more consulates are adding the  DS-160 requirement every day.</p>

<p>Russian authorities recently released the 2010 work permit quota  distributions for each region of the Russian Federation. The Russian  government sets a national quota for the maximum number of available  work permits each year, which are later allocated by region and  occupation. Employers cannot file work permit applications on behalf of  foreign workers until the allocation figures are released. Now that they  have been, employers may now file work and employment permit  applications and invitation letter applications for 2010.</p>
<p>Nationwide,  the quota will be 1,944,356 for all types of work permits in 2010. This  figure is based on Russian employers&#8217; reported needs for 2010. The  number of work permits reserved for Moscow city is 250,000 overall.  There is an additional 85,600 for the outlying Moscow region.</p>
<p>An  additional 583,307 quota numbers will be held in reserve for all  regions of Russia. The reserve quota may be made available to employers  later in the year, at the discretion of Russian authorities.</p>

<p>As previously reported, the Foreign Division of the Federal Police Department of São Paulo in Brazil has changed the registration procedures for work permit holders. In general, foreign nationals who will remain in Brazil for more than 90 days must register with the Federal Police within 30 days of entry. Foreign nationals holding work permits for employment in São Paulo must now schedule an appointment to register, using a password they can obtain from the Federal Police. Upon receiving the password, the foreign national will automatically receive instructions which will inform him or her of the date and time for the registration. On average, registration appointments are now occurring 35 days after the request. Priority services are no longer available.</p>
<p>Work permit holders are permitted to start working in Brazil before they complete the registration procedures. They are not permitted to travel outside Brazil, however, until registered. In addition, work permit holders cannot obtain Brazilian documents such as the CTPS (employment and social security booklet) or their RNE Card, the form of identification used by foreign nationals in Brazil, until their registration is complete. The 35-day wait for registration appointments will delay the issuance of these documents, which may delay the ability of employers to add work permit holders to Brazilian payrolls.</p>

<p>U.S. Citizenship and Immigration Services will begin accepting Fiscal  Year (FY) 2011 H-1B cap petitions on April 1, 2010. Though the business  immigration community does not anticipate the huge initial surge of  filings and rapid cap exhaustion of past years, filing petitions on  April 1, or at least during the first five business days of the filing  period, is still the best option to ensure that your organization can  meet its H-1B hiring needs for the coming fiscal year.</p>
<p><strong>When  Might the Cap Be Reached?</strong></p>
<p>This year, the pace of cap  usage during the upcoming filing season is difficult to predict because  of several competing factors. The fiscal 2010 cap was reached just a few  months ago, so there is not likely to be the kind of pent-up demand  that employers have experienced in previous H-1B seasons. At the same  time, improvements in the economy and in some industries could mean more  cap petitions than last year’s slower overall filing rate would  suggest. Even though cap usage was generally slow throughout most of the  last fiscal year, there was a spike in quota number usage in November  and December, suggesting a resurgence of demand.</p>
<p>Under agency  regulations, if USCIS receives more than enough petitions to reach the  65,000 standard cap in the first five business days of the filing season  – Thursday, April 1, 2010 through Wednesday, April 7, 2010 – it runs a  lottery to select the cases that are awarded quota numbers. Eligible  advanced-degree filings would continue to be accepted until sufficient  numbers are received to exhaust the 20,000 exemption for these cases. If  more than 20,000 advanced degree exemption-eligible cases are received  during the initial five days, but the standard cap has not been reached,  the otherwise exempt cases will simply spill over to the standard pool.</p>
<p>Cases that are not selected in the lottery are rejected and  returned along with their filing fees. If the quota is not reached  during the first five days, as occurred during the FY 2010 filing  season, USCIS continues to accept filings until it determines that it  has received enough cases to meet the cap for the year.</p>
<p><strong>Planning  for the Filing Season</strong></p>
<p>If your organization is planning  to petition for H-1B employment in FY 2011, contact your designated  Fragomen professional to discuss the application process. As always,  advance preparation is key. Timing is particularly important this year  because of the uncertainty about numbers and the fact that the opening  of the filing period falls during several holidays. Some important  points to keep in mind:</p>
<ul>
<li><strong>Gather supporting documentation promptly.</strong> Petition  documentation should be gathered and prepared as soon as practicable,  especially in light of USCIS’s new policies on documenting the  employer-employee relationship in H-1B cases (discussed further <a href="http://www.fragomen.com/newsresources/xprNewsDetailFrag.aspx?xpST=USAlerts&amp;news=693&amp;nid=9aba721b-a754-4833-92bd-ac4a349aebe6&amp;clid=477c113e-0038-4340-9119-014b889a79c5&amp;cid=8455ed83-ecc2-46e9-a3ce-00ac23eb6ca1&amp;ce=2NfpnY3lWciW1vO7VWKySTMLYGW5Wzr2" target="_blank">here</a>).</li>
<li><strong>Get certified LCAs as soon as possible.</strong> Because of new procedures and longer processing times, labor condition  applications (LCAs) should be sought from the Department of Labor well  in advance of April 1. USCIS’s <a href="http://www.fragomen.com/united-states-02-25-2010/">narrow policy</a> on accepting H-1B filings without certified LCAs will expire on March 9  &#8212; weeks before the April 1 opening of the filing season. (The agency  had originally stated the policy would expire on March 4, but has since  clarified that the last date for filing within this limited exception is  March 9.)</li>
<li><strong>Be prepared for last-minute procedural changes.</strong> It is not unusual for the government to announce changes in the filing  process shortly before the April 1 opening date. Employers should note,  however, that proposed changes to the Form I-129 nonimmigrant worker  petition, reported <a href="http://www.fragomen.com/SnapshotFiles/ba043cc6-7a59-4e64-a326-e0ee53dcc2ce/Subscriber.snapshot?clid=477c113e-0038-4340-9119-014b889a79c5&amp;cid=8455ed83-ecc2-46e9-a3ce-00ac23eb6ca1&amp;ce=2NfpnY3lWciW1vO7VWKySTMLYGW5Wzr2">here</a>, are  still in the review process and, if ultimately approved, would not take  effect until after the opening of the FY 2011 H-1B filing season.</li>

<p>Over the past week, Fragomen has learned that   numerous employers throughout the United States have recently received   notices of I-9 inspection from U.S. Customs and Immigration Enforcement   (ICE). ICE officials have not been able to confirm that these audits are the   result of a nationwide initiative akin to the programs that resulted in the   652 and 1,000 audits announced last July and November respectively. However,   ICE did issue a press release yesterday announcing that its Special   Agent-in-Charge in New Orleans had issued 180 audit notices to employers in   Alabama, Arkansas, Louisiana, Mississippi and Tennessee. In fact, the reports   received by Fragomen suggest that increased audit efforts are occurring in   far more than just these five states.</p>
<p>Even in the absence of any specific nationwide initiative, the growing number   of audits is consistent with the Department of Homeland Security&#8217;s focus on   strict enforcement of the employment eligibility verification laws against   employers. It is more important than ever for employers to be proactive in   ensuring strict compliance with the I-9 program and other immigration-related   requirements, as it is always preferable for an employer to discover and   correct errors during a self-audit than to wait for the government to find   violations.</p>

<p>Foreign nationals who are trying to fill out Form DS-160, the new, fully electronic nonimmigrant visa application, have been experiencing widespread technical problems and delays. The Department of State (DOS) is attempting to resolve the problems, but in the meantime, individuals who are unable to complete the online form should check with the consulate where they will apply for alternate application procedures. Employers should be aware that foreign employees may be delayed in obtaining their visas and entering or reentering the United States while the system problems persist.</p>
<p>Technical problems have affected the DS-160 system for several months, but have increased markedly in recent days because a very large number of consulates began to require the online form as of March 1. Due to the flood of new applications, the electronic system became overloaded. DOS is in the process of fully implementing Form DS-160 at all consulates. The form is expected to become mandatory by April 30, 2010, when it will completely replace Form DS-156, the paper-based nonimmigrant visa application.</p>
<p>As an interim measure, many consulates – with the exception of those in Mexico – have temporarily resumed accepting the paper Form DS-156 and accompanying forms. Foreign nationals who are having difficulty completing Form DS-160 online should check with the consulate to determine whether Form DS-156 can be submitted as an alternative. If the consulate will accept Form DS-156, applicants may access it and other paper-based visa application forms <a href="http://travel.state.gov/visa/frvi/forms/forms_1342.html">here</a>. After completing the form, applicants must print out a hard copy and bring it to the visa interview.</p>

<p>Companies that sponsor   “S” Pass and Work Permit holders will be required to pay increased foreign   worker levies starting on July 1, 2010. For “S” Pass holders, the monthly   levy per foreign worker will be raised to SGD100-120 (approximately US $71 &#8211;   $85) beginning July 1, 2010, and gradually increase to a maximum of   SGD150-250 by July 2012. For Work Permit holders, the changes to the levy   tiers and rates will be based on the employer’s industry sector.</p>
<p>Beginning July 1,   2010, employers that sponsor “S” Pass and Work Permit holders will be   required to pay increased monthly levies for their foreign employees. The   levies will increase gradually in stages through July 1, 2012. By increasing   the levies, Singapore’s Ministry of Manpower (MOM) seeks to regulate the   demand for “S” Pass and Work Permit holders and encourage hiring of local   workers and foreign nationals with higher skills and qualifications.</p>
<p>The MOM also announced that it will increase monitoring and enforcement   activities against employers that attempt to recover levies from their   foreign workers, whether directly or indirectly. Employers that do so may   face prosecution and may be prevented from hiring foreign workers.</p>
<p><strong>“S” Pass </strong></p>
<p>The MOM is introducing a new two-tier levy system for holders of “S” Passes,   a type of employment pass for middle-level skilled foreign workers earning a   basic salary of at least SGD1,800 a month. Employers will be required to   classify their “S” Pass holders into two tiers: (i) a basic tier comprised of   the “S” Pass holders that make up less than 20 percent of the employer’s   total workforce, and (ii) a second tier consisting of remaining “S” Pass   workers that make up 20-25 percent of the company’s total workforce. Note the   “S” Pass quota limits the number of “S” Pass holders an employer can hire at   25 percent of the company’s total workforce.</p>
<p>The monthly levy per “S” Pass holder will be raised from the current rate of   SGD50 to SGD100 for the basic tier, while a new rate of SGD120 will be   introduced for the second tier. These levy rates will be adjusted every six   months until July 1, 2012, when the basic tier levy will reach a maximum of   SGD150 while the second tier levy will reach a maximum of SGD250.</p>
<p><strong>Work Permit </strong></p>
<p>The new levy tiers and rates for Work Permits, a type of employment   authorization for unskilled and semi-skilled foreign workers with a basic   monthly salary of less than SGD1,800, will be based on the sponsoring   employer’s industry sector (e.g. manufacturing, services, or construction).   The changes are very detailed, but in general, there will be a greater   differentiation in levy rates between skilled and unskilled Work Permit   holders.</p>
